Terms and conditions
Terms and conditions of Tulip Guide Holland
Version 1 November 2026
This is a translation of my Dutch terms and conditions. If the two differ, the Dutch text prevails.
Article 1 — Who I am
Tulip Guide Holland, a business of Jean Paul Bardelot FotografieOnderdijk 103, 1693 CC Wervershoof, the Netherlands
Phone: +31 6 50 62 88 62
Email: info@tulipguideholland.com
Chamber of Commerce (KvK): 69051046
VAT number: NL002094614B12
Article 2 — Definitions
- I: Tulip Guide Holland, the guide;
- you: the person who requests or books a tour with me, privately or on behalf of a business;
- participants: everyone who takes part in the tour, including you;
- tour: a private tour that I guide, including a photo shoot or photo workshop if you book one.
Article 3 — When these terms apply
- These terms apply to all my proposals and to every tour you book with me, unless we agree otherwise in writing.
- Your own terms, such as a company's purchasing conditions, do not apply.
- I may change these terms. For a tour that has already been booked, the terms that applied at the time of booking remain in force.
- If a provision is invalid, the other provisions remain in force. We then agree on a replacement that stays as close as possible to the original intention.
- If you are a consumer, these terms do not limit the rights you have by law.
Article 4 — Request, proposal and booking
- A request through the website is not yet a booking. After your request I send you a proposal with the price, the travel costs and the programme.
- A proposal is valid for 14 days. Obvious mistakes or typing errors in a proposal do not bind me.
- The booking is final once you accept the proposal by email and I confirm the booking.
- Prices are in euros and include VAT. If you book on behalf of a business, I also state the amount excluding VAT. Travel costs are listed separately in the proposal.
- Third-party costs, such as admission, parking, e-bike rental, the steam tram ticket and lunch, are not included in the price unless the proposal says otherwise.
- The price applies to the number of participants in the proposal. If fewer people take part, the price stays the same. If more take part, we discuss the price in advance.
Article 5 — Payment
- After the confirmation you receive an invoice for a 50% deposit, payable within 7 days.
- The balance is due no later than 14 days before the tour. If you book less than 14 days before the tour, you pay the full amount immediately after the confirmation.
- If a payment is late, I send a reminder with a payment term of 14 days. If you still do not pay, I may charge statutory interest and collection costs as permitted by law.
- If the full amount has not been paid on the day of the tour, I may cancel the tour. Article 7 then applies as if you had cancelled yourself.
Article 6 — No cooling-off period
A tour takes place on a fixed date. As a consumer you therefore have no statutory 14-day cooling-off period (Article 6:230p of the Dutch Civil Code). You can still cancel or reschedule under Article 7.
Article 7 — Cancelling or rescheduling by you
- You cancel or reschedule by email.
- Up to four weeks before the tour, cancelling or rescheduling is free of charge. If you cancel, any deposit you have paid is refunded.
- Between four weeks and one week before the tour, you pay 50% of the price.
- Within one week before the tour, you pay the full price.
- Costs I have already incurred with third parties on your behalf, for example for admission tickets or a reservation, are always charged.
- If your party does not show up, you pay the full price. If you arrive late, the tour still ends at the agreed time.
Article 8 — Weather and bloom
- A tour goes ahead in cloudy weather, light rain and normal wind. Good rain gear is recommended.
- In case of thunderstorms, storms, a code orange or red weather warning from the KNMI, or other weather in which cycling safely is not possible, I may cancel or adjust the tour. I let you know as early as possible.
- If I cancel the tour because of the weather, we look for another date together. If that is not possible, you get back the amount you paid for the tour. In that case this article takes precedence over Article 7.
- Tulips are a natural product. When they bloom depends on the weather, and growers top the flowers at full bloom to keep the bulb strong. I plan the route around what is in bloom that week, but I cannot guarantee that particular fields or colours will be in bloom. This does not entitle you to a discount or free cancellation.
Article 9 — If I am unable to guide
- I guide the tours myself. If I am prevented by illness or force majeure, I try to arrange an equivalent guide, but only if you agree.
- If that is not possible, or you do not want it, we find another date or you get back the full amount you paid.
- I do not reimburse other costs you have incurred, such as travel or hotel costs.
Article 10 — During the tour
- Participants follow the guide's instructions and the traffic rules.
- Participants must be able to cycle independently and safely. Please tell me in advance if someone has limited mobility or if there is anything else I should take into account.
- You rent the e-bikes from a rental company. The rental company's terms apply to the rental, including in case of damage to or theft of the bike.
- Bulb fields are the private property of the growers. Participants only enter a field if the grower has given permission and I indicate so.
- Children under 18 take part under the supervision and responsibility of an adult.
- If a participant endangers themselves or others, I may exclude that participant from the tour or part of it. No refund is given in that case.
Article 11 — Photo shoot and photo workshop
- For a photo shoot, I select and edit the photos myself. You are not entitled to unedited files or to photos that are not in the selection.
- I deliver the photos within ten working days after the tour via a secure download link. This is a target, not a guarantee.
- I keep the photos for six months after delivery. After that I am not obliged to deliver them again.
- I retain the copyright of the photos. You may use the photos privately, including for printing and on your own social media. If you book on behalf of a business, the business may also use the photos in its own communications. Any other use, such as in advertising or by third parties, requires my written permission.
- You may use the photos once the full amount has been paid.
- For a photo workshop, participants use their own smartphone or camera. I am not responsible for the suitability of that equipment or for damage to it, unless the damage is caused by my fault.
Article 12 — Photos for my own promotion
- I only use photos in which participants are recognisable on my own website or social media if those participants have given permission beforehand.
- You can withdraw that permission at any time. I then remove the photos as soon as possible from the channels I manage.
Article 13 — Liability
- I carry out every tour carefully and to the best of my ability.
- I am only liable for direct damage resulting from a mistake on my part. I am not liable for indirect damage, such as consequential damage or missed travel arrangements.
- My liability is limited to the amount paid out by my liability insurance in that case. If the insurance does not pay out, my liability is limited to the price of the tour.
- I am not liable for damage caused by participants or by third parties, such as the bike rental company, Keukenhof or the steam tram, nor for loss or theft of participants' belongings, unless the damage is caused by my fault.
- These limitations do not apply in case of intent or deliberate recklessness on my part.
- A claim for damages lapses if you do not report it to me within twelve months after discovering the damage.
Article 14 — Complaints
- If you are not satisfied with something, please let me know by email as soon as possible, preferably within 14 days after the tour. Describe as precisely as possible what went wrong.
- I respond within 14 days and look for a solution together with you.
Article 15 — Force majeure
- If one of us cannot fulfil an agreement because of circumstances beyond anyone's control, such as government measures, transport disruptions, natural disasters or extreme weather, this is force majeure.
- In case of force majeure we look for another date together. If that is not possible within a reasonable time, either of us may cancel the booking free of charge. You then get back the amount you paid, less any costs I have already incurred with third parties on your behalf.
Article 16 — Personal data
How I handle your data is described in my privacy statement.
Article 17 — Applicable law
- Dutch law applies to every agreement with me.
- If you are a consumer living outside the Netherlands, you keep the protection that the mandatory rules of your own country give you.
- A dispute is submitted to the competent court in the district of North Holland, unless the law provides otherwise.
